DA: Columbus County Sheriff's Deputies cleared for using deadly force

TABOR CITY, NC (WWAY)-- The District Attorney's Office cleared two Columbus County Sheriff's Deputies for their use of deadly force.

The District Attorney says they will not face charges for shooting and killing a murder suspect. Dion Brown was wanted for murdering a grocery store clerk in Loris, South Carolina, in late April.

On April 28th police contacted the Columbus County Sheriff's Office for help finding Brown in Tabor City. Deputies saw Brown cross over third street leaving a house they say brown set on fire where Eugene Banks was later found dead.

Two deputies followed Brown down a trail behind the house. Brown started firing shots at them hitting Deputy Justin Hern in his bullet proof vest. Hern and Deputy Robert Williamson fired back, killing Brown after hitting him several times.

Today DA Jon David said that based on the finding of a SBI investigation, both deputies acted appropriately when they shot Brown and will not face charges.

David said Brown likely would have been charged with Banks's death and for shooting Deputy Hern as well as the arson.
